What Is The Statute Of Limitations For Crime Victim Lawsuits?

The statute of limitations for personal injury or wrongful death lawsuits is normally two years in Georgia.

The generally accepted "two-year" statute of limitations however is oftentimes tolled under O.C.G.A. § 9-3-99 with respect to any cause of action in tort that may be brought by the victim of an alleged crime which arises out of the facts and circumstances relating to the commission of such alleged crime committed in Georgia and may be tolled from the date of the commission of the alleged crime or the act giving rise to such action in tort until prosecution of such crime or act has become final or otherwise terminated, provided that such time does not exceed six years. This exception to the generally accepted two-year statute in personal injury civil actions came about as a result of Beneke v. Parker, a 2009 case found at 285 Ga. 733, 684 SE 2d 243.

If you are suing the state, a city or a county, you must first file a specific notice letter (known as an ante litem notice) within very specific deadlines and in accordance with extremely specific detail:

  • For claims against a city or municipality, you must file an ante litem notice within six months of the claimed injury;
  • For claims against a county or the State of Georgia, you have one year from the date of the claimed injury to file the ante litem notice
